Brazil changes eFX settlement rules for overseas counterparties

A restriction on virtual assets in the eFX counterparty settlement leg took effect on 1 October. Businesses need to inspect their actual route.

BCB Resolution 561 took effect on 1 October 2026. Adopted on 30 April, it restricts settlement between an eFX provider and its overseas counterparty: virtual assets are excluded, with a foreign-exchange transaction or a non-resident real-denominated account in Brazil required. The requirement also covers adjustments and reverse operations between those parties.

A buyer may still see an ordinary price, familiar checkout and order confirmation. The interface does not show how the provider settles with its overseas partner. Businesses therefore need to distinguish the customer's purchase from the subsequent movement of funds within the financial chain.

Consider a hypothetical foreign seller collecting revenue from Brazilian buyers through an intermediary. Assessing the change requires identifying that intermediary's role and the way it settles with the foreign party. A stablecoin used somewhere in a corporate group is insufficient information; its specific use in the affected link is what matters.

October also contains a registration milestone

For already authorised institutions providing eFX, the resolution provides for registering the activity in Unicad by 30 October 2026. That deadline should be distinguished from the settlement rule's effective date.

The merchant's practical review therefore has two parts: the route used now and the servicing entity's status. One answer cannot substitute for the other. An organisation may be discussing future registration actions while its settlement arrangement already requires separate attention.

Refunds need their own place in the analysis. If a successful sale and its reversal take different internal paths, checking only the first leaves a material part of the service unexamined. The commercial agreement and accounting record should make both movements explainable.

This news concerns an earlier measure taking effect. It does not establish a general prohibition on all stablecoin activity in Brazil. Application to a specific model should be assessed against the current full text with local professional advice.

What a foreign seller should check

If a business collects payments from buyers in the country through an intermediary, it is reasonable to request a short written description of the arrangement:

  • Which legal entity acts as the local provider, and what is its role in the chain?
  • How is settlement with the foreign party carried out: a foreign-exchange transaction, a non-resident real-denominated account or another route, and has it changed since 1 October?
  • How are refunds and adjustments processed, and do they follow the same route as the original sale?
  • Has the provider completed the registration step due by 30 October, and how will it confirm this?
  • How will the changes affect settlement timing, exchange rates and fees for the seller?
  • Who will notify the seller if the arrangement has to be restructured, and how much notice will be given?

Risks and limitations

If an intermediary previously used virtual assets in the settlement link, restructuring the route may temporarily affect payout speed or conversion costs. Sellers should monitor actual settlement times and rates during the first weeks after the change and compare them with earlier data.

Another risk is an incomplete picture. A provider's answer may describe the main flow but not the exceptions: partial refunds, disputes and amount adjustments. Those are where accounting discrepancies most often surface. Finally, this analysis does not replace legal review: conclusions about how the requirements apply to a particular model should be based on the current text of the resolution and local professional advice.
